I
Mithra the guardian of contracts. Ahura Mazda enjoins upon Zarathushtra not to break the contract that is entered into with the righteous or with the wicked, for Mithra stands for both the righteous and the wicked.151 In his role of genius of light he guards the sanctity of oaths, and the word mithra in the Avesta is frequently used as a common noun, meaning 'contract.'152 For that reason, he who violates the oath, whether it be with a believer or a non-believer, feels the visitations of the stern angel's wrath. The crime of the one who thus violates a contract is called Mithra-druj, 'deceiving Mithra.' Such a criminal is heavily punished, and his guilt falls upon the shoulders of his kinsmen for years in the next world, making them answerable for it by punishment.153 The ethics of thus holding a man's family and kinsmen responsible for his guilt seems to be a relic of the primitive type of group morality.

Mithra as a war divinity. Incidental allusion has been made above to Mithra as the lord of hosts. For that reason it is easy to comprehend the fact that warring nations invoke Mithra for help before going into battle; and the lord of hosts sides with that army which excels in offering sacrifice.154 When Mithra marches out amid the hostile armies on the battlefield, he throws confusion into the camp of the enemy that has offended him, [189] binds the hands of his offenders, covers their eyesight, takes away their power of hearing, deprives their feet of movement,155 and breaks asunder their lines of battle, striking terror in their entire array.156 Though the enemy use arrows and spears, swords and maces, they nevertheless miss the mark in every case,157 and, all the while, Mithra rushes destructively from a thousand directions against the foes.158 The adversaries who have lied unto him he kills by fifties and hundreds, by hundreds and thousands, by thousands and tens of thousands, by tens of thousands and myriads.159 Confusing their minds, he shatters their limbs and breaks their bones asunder,160 at the same time as he throws down their heads161 he enters the battlefield in person, and levels his club at both the horse and the rider.162

۷. گنج ِ شایگان و بیهمتای ِ [فرهنگ ِ] ما
Our Unparalleled and Supreme Treasure
In the history of mankind's progress during the last four thousand years, our ancestors, known as Iranians, have contributed their share. Renowned as an extremely mighty nation for almost three thousand years, during the last 1300 years we are existing as the world's most microscopic minority community. The ravages of time have left no stone unturned to cull and glean from all that was ours and to destroy every remnant of it. It has annihilated all signs and significance of Persian aura, Kyanian radiance and Parsi glory.
Unappreciative generations have not cared to preserve even a few ruins faintly reminiscent of Peshdadian and Kyanian kingship. The remembrance of all the greatness and glory of the Hakaemenians and Sasanian Empires is encompassed in relics of ruins, writings and coins. Only our unparalleled and supreme treasure, Spitama Zarathushtra’s sublime religion, has escaped the assault of time. Not a single flame of the innumerable fires kindled in the three thousand years of sovereignty remains ablaze. The Atash ni Nyash prayer of millions of Zoroastrian souls through three thousand years to let the sacred fire burn eternally, has not been fulfilled. Each and every fire has been extinguished. Their magnificent Atashkadehs have left no mark on the sands of time, The Fire Temples that are present today in the ancient motherland of Iran are of recent origin.
After the sun set on the Persian Empire, when we arrived in India twelve hundred years ago, the sacred fire was brought to Sanjan whence it proceeded across the Baharot Mountains and through the forests of Bandsda to Navsari and onwards to Surat, thence back to Navsari and Valsad on to Udvada in 1742 where it has remained. This is the oldest and most sacred 'sanctum sanctorum' that unites our community all over the world. The adherents of various faiths have various places of pilgrimage. This is our one and only place of pilgrimage. Our religious fervour and devotion draws us with one accord towards Udvada that has been sanctified by the glory of this sacred fire. Zoroastrian faith and Zoroastrian zeal consider it as the most precious possession of the entire community. And verily is it so.

صدور حکم دادگاه بنفع شاکی در این مورد و تبدیل این آثار تاریخی به کالای تجاری میتواند باعث از بین رفتن قسمتی از میراث فرهنگی ایرانیان آمریکا یی تبار و سایر ایرانیان گردد
در هر صورت صدور چنین رأیی مغایر سیاستهای معمول برای حفظ و توسعه مبادلات فرهنگی از راه حفظ آنها در مقابل ادعاهای مالی خواهد بود
دادگاه نباید با تفسیر قانون منع محاکمه دولتهای مستقل خارجی باعث چنین عملی گردد
Conclusion:
In sum, a judgment for Plaintiffs in this case may well cause a portion of the cultural property of Iranian-Americans and other persons of Iranian descent to enter into the private stream of commerce where it will be dispersed and potentially lost or destroyed. In any case,such a ruling would be contrary to the well-established national and international public polifavoring the preservation of cultural property and the promotion of cultural exchange through protection against judicial attachment.
The Court should not construe the FSIA to produce such a result.
